Article 1 – Scope of Application
These General Terms and Conditions of Sale (hereinafter referred to as the “General Conditions”) apply without restriction or reservation to all sales concluded between DIGISALES LLC, whose registered office is located at 212 N. 2nd St. STE 100, Richmond, KY 40475, United States, and any user (hereinafter the “Client”) of the website www.marocclothes.com (hereinafter the “Site”) wishing to make a purchase.
These General Conditions of Sale are accessible at any time on the Site and will prevail, where applicable, over any other version or any contradictory document.
These General Conditions of Sale may be subject to modifications.
DIGISALES LLC reserves the right to modify its General Conditions of Sale at any time without prior notice to the Client. The modified General Conditions of Sale will be enforceable against the Client from the moment they are posted online for products ordered after their posting.
Each purchase on the Site is subject to all clauses of the General Conditions of Sale applicable at the date of the order. The Client can only validate their order after having read the present General Conditions and accepted them by checking the dedicated box.
DIGISALES LLC considers that by validating their order, the Client has duly read the General Conditions of Sale and accepts them without reservation.
The applicable conditions enforceable against the Client are those in effect at the time of the effective validation by the Client of their order recorded on the Site.
These General Conditions of Sale apply to the exclusion of all other conditions, and particularly those applicable for sales in physical stores or through other distribution and marketing channels.
Article 2 – Purpose
The Site allows DIGISALES LLC to offer for sale artisan and decorative items, cosmetics, gourmet food products, and all items designated and created by and for DIGISALES LLC.
The Client must have the capacity to conclude this contract, meaning they must be of legal age and not under guardianship or curatorship.
The Client agrees not to make purchases for resale.
These General Conditions of Sale aim to govern:
- The organization of legal relations between DIGISALES LLC and the Client.
- The sales procedures between DIGISALES LLC and the Client (ordering, delivery, etc.).
Article 3 – Products:
The products offered for sale by DIGISALES LLC are those listed on the site at the time of the user’s consultation of the site and within the limits of available stock.
In case of unavailability of one of the products, the buyer will be informed as soon as possible.
The photographs and texts illustrating the products do not constitute contractual obligations. If these photographs and/or texts contain inaccuracies, DIGISALES LLC cannot be held liable for this.
The Seller offers handmade items (textiles, ceramics, baskets, wooden utensils, jewelry, etc.), which may lead to variations in shades, shapes, finishes, and discolorations that cannot be considered defects, as they relate to their artisanal “handmade” nature, making them unique pieces.
Article 4 – Prices:
Prices are indicated in dollars (USD), all taxes included, including VAT and excluding delivery charges, which remain the responsibility of the user unless specified otherwise.
The prices indicated take into account the applicable VAT at the time of the order. If the VAT rate were to change, these changes could be reflected in the price of the items without the user being notified beforehand.
Any order placed on the site and delivered outside of the United States may be subject to potential taxes and customs duties imposed when the package reaches its destination. DIGISALES LLC is not obliged to check and inform the buyer of the applicable customs duties and taxes.
Prices displayed on the site are guaranteed on the day of the order within the limits of available stock, except for significant changes in costs, particularly VAT, and except for typographical or omission errors.
The indicated prices do not include shipping fees, which will be billed additionally and specified to the buyer on the order summary before the final validation of their order.
DIGISALES LLC reserves the right, which the user accepts, to modify its prices at any time, but products will be charged based on the rates in effect at the time of order registration, subject to…
Article 5 – Ordering Procedure and Terms
5.1 – Client Identification
To place an order, the Client must log in to the Site. The Site is accessible 24/7, subject to incidents affecting service levels.
During their first order, the Client has the option of registering or making a direct order without registration. For subsequent orders, the Client can access their account, if they have created one, by entering their username and password.
The Client is fully responsible for their username and password and agrees to maintain their confidentiality.
5.2 – Placing the Order
The Client wishing to place an order selects products on the Site. Once the selection is made, the Client must click on the validation button. The cart is thus created by the Client.
The ordering process consists of four steps following the validation of the cart by the Client:
- Order Summary: The Client checks the contents of their cart and can, if necessary, modify it and/or enter a promotional code allowing them to benefit from a current offer on the Site. Before definitively validating their order, the Client has the opportunity to make changes if they notice an error in the data entry.
- Express Delivery: The client will be informed of the delivery method offered and the applicable weight rate from the country of departure, which is subject to local shipping rates from international carriers such as Colissimo, GLS, DHL, etc.
- Standard Delivery: The client will be informed of the delivery method offered and the applicable weight rate from the country of departure. They will be contacted by email to schedule an appointment with the delivery company.
- Payment: Once steps 1 and 2 are validated, the Client must select their payment method and validate their payment.
Payment for purchases can be made at the Client’s choice:
- With PayPal Checkout: PayPal is a secure payment method that allows the Client to quickly pay for their order without sharing their banking information with sellers. They only need to have entered this information when creating their PayPal account. It is then encrypted and secured once and for all.
- If the Client already has a PayPal account, they can use it on the Site to pay for their purchases quickly and securely.
- If the Client does not have a PayPal account, they can still choose this payment method. At the time of checking out, the Client is directed to a PayPal page where they enter their banking information (and can choose to create a PayPal account or not).
The debit will occur upon confirmation of the order.
- Bank Transfer: By bank transfer to DIGISALES LLC’s bank account, whose details and RIB will be sent to the client via email. The bank account holder must be the one placing the order (name, first name, and address). The order will be reserved for 72 hours from the validation of the cart and will only be confirmed upon receipt of the transferred amount.
Fraud Prevention during Payment:
DIGISALES LLC reserves the right to request the Client to prove their identity, place of residence, and the payment method used. If these documents are not received, DIGISALES LLC reserves the right to cancel any order.
DIGISALES LLC reserves the right to refuse to honor any order in the event of a dispute related to payment for a previous order.
In the case of non-payment for any reason, a fixed amicable indemnity of $15 will be required by DIGISALES LLC in addition to the invoice amount, increased by bank charge fees billed by DIGISALES LLC’s bank if amicable recovery remains unsuccessful within 10 days from the date of sending the first recovery request, whether this request is sent by registered mail or simple letter. Recovery will be carried out through legal means. The legal collection fees charged by the collection agency acting for DIGISALES LLC directly to the Client are independent of the amicable indemnity.
Confirmation:
The order is firm for the Client upon validation of their order, subject to the implementation of their “Right of Withdrawal,” which they can exercise within fourteen (14) calendar days following the date of receipt or withdrawal of the Order. If this deadline expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.
The client who wishes to exercise their right of withdrawal must return the items within the aforementioned timeframe, in their original packaging, complete and new.
Return shipping costs for items resulting from the exercise of the right of withdrawal are the responsibility of the Client.
Items returned in new condition will be refunded within fourteen days, minus the initial shipping costs charged to the Client, who renounces their purchase, in addition to $2 processing fees.

The Client’s validation of the order and payment for it will lead to the receipt of a confirmation email sent by DIGISALES LLC to the email address provided by the Client.
